Yarbo Installer Program Statement and Disclaimer

Important Notice:
Before applying to become a Yarbo volunteer Installer or seeking Yarbo Installer services, please read and understand this statement and disclaimer carefully. By checking "Agree," or continue to proceed the program, you confirm that you have read, understood, and accepted all terms here.
Project Background & Positioning
The Yarbo Installer Program is a community-based platform that connects Yarbo users who need help with experienced users or local dealers who can provide installation support. Yarbo acts only as a facilitator for introductions and communication. This program is not designed as a profit-making service and does not represent official Yarbo installation services (Yarbo official installation services are charged in select regions. If your address falls within the eligible service areas, official installation service option will automatically appear during checkout). This Installer program services are voluntarily arranged between installers and service seekers (collectively referred to “Users”).
Service Process Introduction
1. When a service seeker selects an installer via the map and submits a service request, the request information will first be received by Yarbo.
2. Yarbo will collect and forward the installation requirements, approximate location, device model, expected installment schedule, budget to the installer selected by the service seeker to confirm whether the installer is willing to accept the request.
3. Only after the installer agrees to accept the request will Yarbo share the service seeker’s contact or other personal information with that installer.
4. If the selected installer declines the request, Yarbo may contact the service seeker to suggest alternative suitable installers and ask whether the service seeker would like to proceed with a different installer.
5. All further communication, coordination, and arrangements shall be conducted directly and independently between the service seeker and the installer.
6. After the service is completed at the agreed time, Yarbo will send a survey to both parties. The Service Seeker can rate their satisfaction, and the installer can share feedback based on their experience, helping us further improve the Installer Program.
Terms and Conditions for Becoming a Yarbo volunteer Installer:
1. Installer Identity and Responsibility:
- The Yarbo volunteer Installer program aims to provide an opportunity for existing Yarbo users to assist other users with the installation of their Yarbo devices. As a Yarbo volunteer Installer, you will receive basic product education materials.
- You understand and agree that you are providing installation services as an independent individual and that Yarbo International Inc. does not assume any legal responsibility for your actions during the installation process. Yarbo International Inc.'s role is strictly limited to providing said product education materials and is not responsible for any equipment failures, damages, or personal injuries that may occur during your service.
Note:We strongly recommend that you purchase the necessary liability insurance before providing installation services to help protect your safety and the rights of other users.
2. Risks and Disclaimer:
- As an installer, you acknowledge and accept that improper installation may lead to equipment failures, suboptimal performance, or other potential risks, for which you will assume full responsibility.
- You agree that you have the necessary competence and qualifications to provide installation services, and that any issues arising from your provision of installation services will not hold Yarbo International Inc. liable for damages or complaints.
- You agree to refrain from performing high-risk maneuvers while providing your services, including but not limited to climbing on roofs, modifying electrical systems, and lifting heavy objects beyond safe limits. You have the right to refuse service if the installation site is a safety hazard.
3. Service Agreement and Fees:
- As a Yarbo volunteer Installer, you will negotiate the installation service fees directly with service seeker. Yarbo International Inc. does not participate in negotiations or payment arrangements for this installation services.
4. Data Privacy and Confidentiality:
- In the provision of installation services, you may encounter personal information of users. You agree to maintain strict confidentiality and not disclose any user data or privacy information to third parties without their permission.
5. Limitation of Legal Liability:
- As an installer, you are required to comply with all applicable laws, regulations, and standards during the installation process. Yarbo International Inc. will not be responsible for any actions that violate laws or regulations.
Terms and Conditions for service seekers to use Yarbo volunteer Installer Services:
1. Nature and Limitations of Services:
- The Yarbo volunteer Installer program is intended to provide users with opportunities to obtain installation services from independent installers. You understand and agree that this service does not include any form of equipment maintenance, troubleshooting, or after-sales support from Yarbo International Inc.
- You agree that the installation services are provided by independent Yarbo volunteer Installers, not directly by Yarbo International Inc.. Yarbo International Inc. serves only as a platform for service connection and will not assume any responsibility for the quality or results of the installation services.
2. Fee Negotiation and Payment:
- As a user seeking installation services, you will negotiate the installation service fees directly with the installer. Yarbo International Inc. does not participate in negotiations or any related payment matters.
3. Risks and Disclaimer:
- You understand and accept that equipment damage, performance issues, or any other loss resulting from improper installation or user error will not hold Yarbo International Inc. responsible.
- The installation of Data Center often involves drilling holes in your building or property, and you are aware of this risk and will choose a suitable location to install the data center
- You agree that any disputes arising from your transaction with the installer will not hold Yarbo International Inc. liable for any legal responsibilities or compensation.
4. Data Privacy and Confidentiality:
- In seeking installation services, you understand and agree that Yarbo International Inc. will collect or store your personal data, and any data exchange between you and the installer will be handled confidentially by both parties.
5. Limitation of Legal Liability:
- You understand and agree that Yarbo International Inc. is not liable for any damages, accidents, or equipment issues that may occur during or after the installation process.
General Terms (Applicable to Both Installers and Service Seekers):
1. Responsibilities and Obligations Intellectual Property:
- Yarbo International Inc. retains all rights to its brand, device designs, installation guidelines, and other related intellectual property. No individual may reproduce, modify, or publish related content without the company’s authorization.
- To the fullest extent permitted by law, the Users agrees to indemnify, defend and hold harmless Yarbo International Inc. from and against all claims, damages, liabilities, costs and expenses (including attorneys' fees) arising from his/her actions in the Yarbo Installer Program.
- Yarbo International Inc. reserves the right to remove an Installer in the event that Yarbo International Inc. receives multiple complaints or discovers a violation.
2. Disclaimer Updates:
- Yarbo International Inc. reserves the right to update this Disclaimer at any time without prior notice to users. The updated disclaimer shall become legally effective upon publication. Users are responsible for regularly reviewing and understanding the latest disclaimer terms.
3. Dispute Resolution:
- The interpretation of this agreement and any related disputes shall be governed by the laws of the state of New York, U.S.A. Any disputes arising from this agreement shall be submitted to appropriate court in the State of New York with jurisdiction for resolution.
- Yarbo International Inc. does not participate in or mediate any disputes between users and installers regarding service fees or installation service. If either party has concerns about potential disputes, we recommend signing a separate agreement between the installer and the user prior to the on-site service.
4. Risk Warning:
- Users are advised that improper installation of the Yarbo Data Center may result in performance issues and agree to bear all risks and consequences arising from such installation. Users should ensure adherence to installation guidelines and take necessary safety precautions. Users may contact Yarbo for assistance if uncertainties arise.
- All installer profiles, service descriptions, and experience statements are provided solely by the installer. Yarbo does not verify, endorse, or validate such information.
5. Public Information and Privacy Consent(For Installers During Registration):
You explicitly understand and agree to the following terms regarding the display and use of your personal information:
- Public Information: You agree that parts of your information, including your name (or nickname), "How I can help" description, device module will be publicly displayed on the Yarbo Installer map and lists for service seekers to view and select.
- Avatar/Photo Use Authorization (Optional): If you choose to upload a personal photo as your avatar, you hereby grant Yarbo a non-exclusive, worldwide, royalty-free license to publicly display said photo on pages related to the Installer Program. You may remove or change this photo at any time through your account settings.
- Geographic Location Display: You understand and agree that, for the purpose of showing your service area to users,your general geographic location (e.g., your city, state) will be represented by a pin or a shaded area on the public map. Yarbo commits to never displaying your precise street address on any public-facing map to protect your personal privacy and safety.
- Contact Information Sharing: You agree that your contact information (e.g., phone, email) will only be shared with a specific service seeker after you accept their service request, for the purpose of subsequent independent communication.
6. Data Sharing Consent(For Service Seekers During Request Submission)
As the Service Seeker, you explicitly authorize Yarbo to handle your information in the specific manner described below:
- Direct Collection of Information: You understand and agree that upon submitting this request, you are directly providing Yarbo with your complete "Request Data," which includes personal information such as your name, full street address, and contact details. You authorize Yarbo to collect, store, and process this data to initiate the process of finding an installation service provider for you.
- Initial Information Disclosure to Installers: For the purpose of finding and confirming an interested installer, you hereby explicitly authorize Yarbo to share parts of your "Request Data" (specifically including your installation address and the type of service required) with one or more potential installers, so they may decide whether to accept your service request. You acknowledge and accept that at this stage, parts of your personal information (such as your address) will be made known to a third party (the installer) whom you have not yet selected.
7. Authorization for Final Contact Information Exchange:
- Yarbo will notify you once an installer agrees to accept your request. You hereby pre-authorize* Yarbo, upon an installer's "acceptance" of the request, to share your remaining contact information (such as name, phone, and email) with that installer, and in turn, share the installer's contact information with you, to facilitate direct communication between both parties.
- Limitation of Liability and Risk Acknowledgment: You understand that once your information has been shared with an installer according to the process above, Yarbo's role as an information intermediary is complete. All subsequent communication, services, and payments are private matters between you and the installer. Yarbo is not responsible for the use, storage, or security of your data by the installer after it has been shared. You confirm that you understand and voluntarily assume the risks of information disclosure inherent in this process.
